Terms of use

The Basis We Trade On.

Musika introduces buyers and suppliers, constructs commercial transactions and coordinates fulfilment from South Africa into Botswana, Namibia, Zambia and Zimbabwe. These terms set out what that means.

Who You Are Contracting With

Musika is co-owned by Cabanga Africa Group (Pty) Ltd, the South African entity, and Cabanga Africa (Pty) Ltd, the Botswana entity, which built and runs the platform. In these documents "Musika", "we" and "us" means the co-owners acting together.

Each quotation names the party that contracts with you for that order and the role Musika plays in it - selling as principal, or introducing you to a verified supplier.

What Musika Does

Musika is a business-to-business marketplace and trade desk. It sells goods sourced in South Africa to businesses in Botswana, Namibia, Zambia and Zimbabwe through the Musika Store, private product requests and the trade floor.

Who Can Trade Here

Musika is for registered businesses, traders and institutions. Buyers, suppliers, partners and agents accept these Terms, the Privacy Notice and the Marketplace Charter, and confirm their email address before a transaction is submitted. Email confirmation proves control of the address; it is not accreditation.

Quotations

Every line is priced on quotation. A cart, request or trade-floor shortlist is an enquiry, not a purchase. A quotation states the goods, quantities, price, currency and any exchange rate, logistics as its own charge, duties and taxes where known, validity, payment stages and lead time. An expired quotation must be reconfirmed.

Orders and Payment

An order exists when you accept a valid quotation through the trade desk. You pay only into the payment environment confirmed for your order, quoting its reference. A payment is confirmed when the payment environment confirms it, not when proof of payment is sent. Where a transaction calls for escrow, the funds are released only when the goods are delivered as quoted.

Delivery and Risk

Lead time runs from confirmed payment unless your quotation says otherwise. Logistics, border clearing and duties are charged on the invoice unless the quotation states otherwise; you may use your own transporter. Risk passes on delivery or collection as stated in the quotation. See Delivery.

Claims

Report damage, shortage or wrong goods within 48 hours of delivery, with the signed delivery note and photographs. Livestock and perishables are checked at offloading and reported the same day. See Returns and Refunds.

Suppliers

Suppliers are verified South African businesses. Musika charges suppliers a nominal registration fee and 3% of each transaction, deducted at settlement as stated in the supplier's order. A supplier holds its quotation for its validity, dispatches only against a confirmed order and does not substitute without written agreement.

Agents

Accredited agents earn between 1% and 20% of the eligible invoice, depending on the product and order size. The rate is agreed in writing before each order and is paid once the order is paid and delivered. Agents never collect customer money unless Musika authorises it in writing.

Badges and Accreditation

Musika badges - Accredited Supplier, Financial, Operational, Logistics and Media Partner, and Accredited Agent - are issued after checks, used only within the agreed scope and can be suspended or withdrawn.

Restricted Goods

Pharmaceuticals and chemicals are restricted on Musika until certified suppliers are in place. Musika may decline any requirement it cannot source lawfully and safely.

The Trade Floor

Trade-floor posts are anonymous. The trade desk holds the identity of both sides until it makes an introduction. A post is an opportunity to investigate, not a guarantee of stock. Tick "keep this private" and your requirement is worked off the floor.

Language

The site is offered in English, Setswana, chiShona and Chinyanja. Quotations, orders, invoices and these Terms are issued in English, and the English version prevails.

Liability

Musika is responsible for what it quotes and confirms in writing. It is not liable for indirect or consequential loss, or for delays caused by border authorities, strikes, weather or other events outside its control.

Governing Law and Changes
